1. Acceptance of Terms

Welcome to Virgoul. By accessing or using our platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

These terms apply to all visitors, users, and others who access or use the service.

2. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms.

• You are responsible for safeguarding your account password
• You must not share your account credentials with others
• You must notify us immediately of any unauthorized access
• You are responsible for all activities under your account

3. User Roles and Responsibilities

For Students

• Provide accurate information about your learning goals and experience
• Treat teachers with respect and professionalism
• Attend scheduled lessons on time and prepared
• Make timely payments for lessons and services
• Maintain appropriate conduct during lessons
• Have necessary equipment (instrument, stable internet, audio/video)

For Teachers

• Provide accurate professional credentials and experience
• Deliver high-quality instruction at scheduled times
• Maintain professional standards and conduct
• Respond promptly to student inquiries
• Keep profile information current and accurate
• Comply with all applicable teaching standards and regulations

Note: Teachers must also comply with our separate Teacher Terms of Service.

4. Payment and Refunds

Payment Terms

• All payments are processed securely through Stripe
• Students must pay for lessons in advance
• Payment is due at the time of booking confirmation
• All prices are displayed in GBP unless otherwise stated

Cancellation and Refund Policy

Solo Lessons:

• Cancellations 24+ hours before: Full refund or free rescheduling
• Cancellations within 24 hours: Non-refundable
• No-shows: Full forfeiture of payment
• Teacher-initiated cancellations: Full refund or free rescheduling

Group Lessons:

• 14-day cancellation window after booking
• Right to cancel expires after attending first lesson
• Teacher cancellations must be rescheduled

Refunds are processed within 5-10 business days. A processing fee of up to £3 may apply.

5. First Free Lesson

Students receive one free trial lesson with each new teacher:

• One free lesson per teacher (not unlimited free lessons)
• Duration matches the teacher's standard lesson length
• Same cancellation policies apply
• Both parties must agree to continue after trial

6. Acceptable Use Policy

You agree not to:

• Use the platform for any illegal purpose
• Harass, abuse, or harm another person
• Post false, inaccurate, or misleading information
• Impersonate any person or entity
• Collect or store personal data about other users
• Interfere with or disrupt the platform's operation
• Attempt to bypass security measures
• Use the platform to compete with Virgoul
• Share lesson content without permission
• Record lessons without explicit consent

7. Intellectual Property

The platform and its original content, features, and functionality are owned by Virgoul and are protected by international copyright, trademark, and other intellectual property laws.

• Teachers retain ownership of their original teaching materials
• Students may not reproduce or distribute lesson content
• User-generated content may be used by Virgoul for platform improvement
• You grant us a license to use content you post on the platform

8. Content Moderation

We reserve the right to:

• Monitor and review user content and communications
• Remove content that violates these terms
• Suspend or terminate accounts for policy violations
• Report illegal activity to law enforcement

9. Privacy and Data Protection

Your use of the platform is also governed by our Privacy Policy. We collect, use, and protect your personal information in accordance with GDPR and applicable data protection laws.

10. Safeguarding and Child Protection

We are committed to child safety:

• All teachers undergo enhanced DBS checks
• Parents must create accounts for students under 18
• Parents must supervise lessons for students under 13
• Concerns should be reported immediately to support@virgoul.com
• We maintain strict safeguarding policies and procedures

11. Disclaimers and Limitations of Liability

The platform is provided "as is" without warranties of any kind:

• We do not guarantee uninterrupted or error-free service
• We are not responsible for the quality of instruction
• We are not party to agreements between students and teachers
• Technical issues on user devices do not automatically qualify for refunds
• We are not liable for indirect or consequential damages

Our total liability to you for any claims arising from your use of the platform is limited to the amount you paid us in the 12 months prior to the claim.

12. Dispute Resolution

In the event of a dispute:

1. Contact us first to resolve the issue informally
2. If unresolved, we will attempt mediation
3. Final disputes will be resolved through binding arbitration
4. You waive the right to participate in class action lawsuits

13. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms of Service
• Fraudulent, abusive, or illegal activity
• Request by law enforcement or government agencies
• Extended periods of inactivity

You may terminate your account at any time through your account settings. Upon termination, your right to use the platform will immediately cease.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes via email or platform notification at least 30 days before the effective date. Your continued use of the platform after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in England and Wales.
